These General Terms and Conditions govern the use of the Xtabula platform. They apply to visitors, registered users, advertisers, clubs, agencies, master accounts and other users. By registering, using the platform, publishing an advertisement or purchasing XCoins, the user accepts these General Terms and Conditions.
1. Scope and Language
Xtabula GmbH operates an online platform at xtabula.ch for advertisements in the adult, escort, companion and lifestyle sectors, as well as for supplementary offerings such as job, space, property or apartment listings within Switzerland and, where permissible, in other markets. These General Terms and Conditions apply to all types of use of the platform. Supplementary conditions may apply to individual functions, payment methods, promotions, commercial accounts or additional offer areas. In case of doubt, the German version shall be authoritative.
2. Role of Xtabula as a Technical Platform
Xtabula solely provides the technical infrastructure for the publication, management, searching and contacting related to advertisements. Xtabula does not act as a provider, employer, principal, intermediary, agency or party to the services described in the advertisements. Xtabula does not broker erotic or other personal services, does not organize meetings, does not coordinate appointments, does not accept orders on behalf of advertisers and does not process payments between visitors and advertisers. Contracts, agreements, contacts and services are concluded exclusively between the participating users. Insofar as job, space, property or apartment offers are published, these are also considered platform advertisements, unless expressly agreed otherwise. Xtabula may expand, restrict or discontinue functions without thereby assuming any brokerage, rental, employment or service obligation.
3. Minimum Age, Registration and Accounts
Use is only permitted for adults and legally competent individuals, as well as legal entities. A minimum age of 18 applies to adult/escort/companion content. Registration is required for advertisements and fee-based functions. Information provided must be complete, current and truthful. Pseudonyms or stage names may be used publicly, provided this does not result in deception or legal infringement. Users may not operate multiple, misleading or accounts used for circumvention without the consent of Xtabula. Agency, club or master accounts may be activated and verified separately. Access credentials must be treated confidentially.
4. Age Verification, KYC and Agency/Club Accounts
Advertisers, clubs, agencies and master account holders must undergo age, identity and authorization verification before activation or when required. Xtabula may use external verification or KYC service providers for this purpose and may request additional documentation.
Clubs, agencies or other third parties may only manage profiles if the persons depicted are of legal age, have consented and have permitted the management of their profiles. Upon request, appropriate evidence must be provided. In case of doubts, complaints, authority inquiries, security risks or suspected abuse, Xtabula may block content, restrict accounts, freeze XCoins, request further evidence or inform relevant authorities.
Users confirm that all information provided to Xtabula is correct, complete and current. This applies in particular to age, identity, legal capacity, residency status, work authorization, permits, regulatory requirements, tax obligations and other legal prerequisites.
Advertisers, clubs and agencies are themselves responsible for ensuring that they fulfill all permits, residency and work authorizations, tax registrations and other legal requirements necessary for their activities. Xtabula assumes no obligation to review or guarantee that a user possesses all personal, professional, immigration, tax or regulatory prerequisites, except to the extent legally required.
The use of forged, altered, third-party, abusively used or factually incorrect documents is strictly prohibited. This applies in particular to identification documents, residency documents, permits, powers of attorney, corporate certificates, consents or other verification materials.
To the extent that users, despite reasonable review and security measures, provide false information, use forged or third-party documents or conceal underage status, missing permits, missing residency or work authorization, illegal employment or other legal violations, Xtabula shall not be liable for this to the extent permitted by law and provided that Xtabula is not guilty of intentional or grossly negligent breach of duty.
In case of doubts, complaints, authority inquiries, security risks or suspected abuse, underage status, forged documents, missing permits, missing residency or work authorization, illegal employment, human trafficking, exploitation, money laundering or other illegal activities, Xtabula may block content, restrict accounts, freeze XCoins, request further evidence, inform payment service providers or notify relevant authorities, to the extent legally permissible or required.
5. Advertisements, Content and Rights
Users are solely responsible for all published content. Advertisements, prices, availabilities, telephone numbers, links, images and information must be lawful, current, truthful and not misleading. Users confirm that they hold all rights and consents to published images, videos, texts, profile information and links. For persons depicted, their consent must be obtained. Upon publication, the user grants Xtabula a non-exclusive, technically necessary right of use to store, display, format, moderate, translate and present content on various devices on the platform. Xtabula may review, reject, adapt, deactivate or delete content.
6. Prohibited Content and Prohibited Use
Prohibited in particular are unlawful, misleading, exploitative, fraudulent, violence-related, discriminatory, defamatory or youth-endangering content, as well as content that infringes the rights of third parties. Specifically prohibited are content, terms, images, links or requests relating to minors or apparently minors, teen/school contexts, human trafficking, coercion, exploitation, violence, non-consent, rape, duress, animals, incest, drugs, date rape drugs, unprotected sex, AO, bareback or comparable formulations. Also prohibited are deepfakes, AI-generated images of persons without clear permissibility, identity theft, third-party images without rights, images without consent, copyright, trademark, personality or data protection infringements, as well as advertising for unlawful or competing offers in inadmissible form. If there is suspicion of criminal acts, minors, human trafficking, coercion, identity theft, fraud or other serious violations, Xtabula may remove content, block accounts, preserve data and inform competent authorities.
Also prohibited are false statements regarding age, identity, residency status, work authorization, permits, tax prerequisites or other legal requirements, as well as the use of forged, third-party or abusively used documents.
7. Prices, XCoins and Fee-Based Functions
Fee-based platform functions may include in particular XCoins, advertisements, profile upgrades, highlights, premium placements, daily, weekly or monthly services and comparable digital platform services. XCoins are a purely platform-internal unit. They do not constitute legal tender, e-money, a financial instrument or withdrawable credit. XCoins are non-interest-bearing, non-transferable and cannot be exchanged back into cash, cryptocurrencies or other means of payment. As of the current status, the following coin packages are offered: 1 XCoin for CHF 15.00, 7 XCoins for CHF 70.00 and 30 XCoins for CHF 180.00. Xtabula may adjust packages, prices, discounts, promotions and bonus XCoins at any time. The price displayed at checkout at the time of purchase is authoritative. Prices are in Swiss francs and, unless otherwise stated at checkout, include statutory VAT. Invoices, credits and payment receipts may be provided exclusively in electronic form.
8. Payment Processing, Refunds and Chargebacks
The purchase of XCoins and other platform services is processed through external payment service providers. Xtabula itself does not process complete credit card or comparable payment data to the extent that these are processed directly by payment service providers. Payments may be rejected, deferred, reviewed or cancelled for technical, regulatory, security-related, anti-money laundering, risk-based or fraud prevention reasons. Xtabula may restrict accounts, XCoins or services in the event of failed, cancelled or abusive payments. Purchased XCoins and already activated digital services are generally non-refundable. Reserved are mandatory legal rights, double charges, demonstrable technical errors or express discretionary decisions by Xtabula. Unauthorized chargebacks, reversals or payment disputes may result in account suspension, freezing of XCoins, recharge of incurred costs, enforcement of outstanding claims and restriction of future payment functions.
9. Ranking, Premium Visibility and Promotions
The visibility and order of advertisements may be influenced by recency, location, availability, quality, user interest, security status, editorial factors or paid highlights. There is no entitlement to a specific placement. Xtabula may offer, change, restrict or terminate promotions, free trial periods, discounts, referral bonuses or bonus XCoins. In case of abuse, fake profiles, multiple accounts, self-promotion or sham transactions, benefits may be denied or reversed.
10. Reports, Security and Compliance
Users may report content, profiles or behavior. Xtabula reviews reports at its own discretion and in accordance with legal obligations. Xtabula may use technical filters, manual moderation, blocking notes, security logs and abuse records to the extent permissible and necessary. Xtabula may take action against fraud, money laundering, identity theft, payment fraud, sanctions violations, human trafficking, minors, coercion, illegal content and other abuse. This includes requests for evidence, blocking, restrictions, removal of content, freezing of XCoins and reporting to authorities or payment service providers.
These measures also apply in case of suspicion of forged documents, missing permits, missing residency or work authorization, illegal employment or other circumvention of legal requirements.
11. Data Protection and Electronic Communication
The processing of personal data is governed by the respective valid privacy policy of Xtabula. For platform operation, registration, verification, payments, invoices, moderation, security, support, legal obligations and legal enforcement, data may be processed and transmitted to required service providers. Legal, contractual and operational communications may be conducted electronically, in particular by email, in the user account, via platform notifications or support messages.
12. Liability and Indemnification
Xtabula does not warrant the accuracy, completeness, timeliness, lawfulness, quality, availability or fulfillment of advertisements, user content, contacts, meetings, services or arrangements between users. To the extent permitted by law, Xtabula is liable only for direct damages caused by intentional or grossly negligent conduct. Excluded in particular is liability for slight negligence, indirect damages, consequential damages, lost profits, reputational damages, data loss, service interruptions, technical disruptions, external links and the conduct of other users.
Users shall indemnify Xtabula against claims from third parties arising from their content, advertisements, links, profiles, legal infringements, payment issues or their conduct, to the extent that they are responsible for such claims.
Users shall indemnify Xtabula to the extent permitted by law from all claims, damages, costs, fees, fines, proceedings and demands arising from their provision of false information, use of forged or third-party documents, acting without required authorization or permission, violating legal obligations or publishing unlawful content, advertisements or offers. This applies in particular to violations of age requirements, residency and work authorizations, permit obligations, tax obligations, personality rights, data protection rights or criminal and administrative law.
13. Blocking, Termination and Deletion
Users may deactivate or delete their account in accordance with the prescribed processes. Statutory retention obligations, outstanding claims, security interests, abuse records and legal enforcement interests remain reserved. Xtabula may temporarily or permanently block accounts, advertisements, XCoins, payment functions or individual features if there is a violation of these General Terms and Conditions, platform rules or laws, false information is provided, payments are problematic, security risks exist or there is reasonable suspicion of abuse. In the event of blocking or deletion due to violations, there is generally no entitlement to a refund of already used services, activated advertisements, consumed XCoins or granted benefits, unless mandatory legal rights prevail.
A blocking or restriction is also permissible in particular if there is suspicion that a user is underage, uses forged or third-party documents, acts without required authorization, residency or work authorization, promotes illegal employment or conceals other legal prerequisites.
14. Amendments, Law and Jurisdiction
Xtabula may amend these General Terms and Conditions if legal, technical, economic, security-related or platform-related reasons so require. The current version will be published on the platform. Material changes will be communicated in a suitable manner. Should a provision of these General Terms and Conditions be or become wholly or partially ineffective, the validity of the remaining provisions shall remain unaffected. Swiss law applies, excluding conflict-of-law rules, to the extent that mandatory law does not prevail. Exclusive place of jurisdiction is Baar, Canton of Zug, Switzerland, to the extent that no mandatory statutory place of jurisdiction prevails.
